Terms and Conditions

1 – Introduction

These Terms and Conditions govern access to and use of the website www.azoresyouthhostels.com, as well as the online booking process. By using the website, the user declares that they have read, understood, and fully accepted these Terms and Conditions, as well as the Privacy Policy and the Cookie Policy.

The website is owned by the private limited company “PJA – Pousadas de Juventude dos Açores, Unipessoal Lda.”, registered at the Land Registry, Commercial and Motor Vehicle Registry Office of Ponta Delgada under single registration and collective entity number 512 042 446, with its registered office at Rua São Francisco Xavier, 9500‑243 Ponta Delgada, and with a share capital of €70,650.00 (seventy thousand, six hundred and fifty euros), hereinafter referred to as “PJA”.

PJA is responsible for the operation of the accommodation provided on the platform, hereinafter referred to as “Azores Youth Hostels” or “AYH”, namely:

  • Azores Youth Hostels Santa Maria, located at Rua Frei Gonçalo Velho, Vila do Porto;
  • Azores Youth Hostels São Miguel, located at Rua São Francisco Xavier, Ponta Delgada;
  • Azores Youth Hostels Terceira, located in Negrito – São Mateus, Angra do Heroísmo.;
  • Azores Youth Hostels São Jorge, located at Cana da Vinha Nova – Fajã Grande, Calheta;
  • Azores Youth Hostels Pico, located at Rua João Bento de Lima, São Roque.

2 – Use of the website

The website and associated services may not be used for illegal, unlawful, or any purposes contrary to these Terms and Conditions.

The personal data provided by the user will be processed by PJA in accordance with the Privacy Policy, with the user acknowledging that such data is true, complete, and up-to-date. PJA shall not be held responsible for any inaccuracies or omissions in the information provided.

PJA reserves the right to suspend, interrupt or terminate the website, totally or partially, temporarily or permanently, without prior notice, accepting no responsibility for any interruptions, technical failures, viruses or other problems that may affect access to or the functioning of the platform.

PJA also reserves the right to change, modify or update these Terms and Conditions at any time, by simply publishing them on the website. The user acknowledges that it is their sole responsibility to periodically consult the current Terms and comply with the applicable provisions each time the website is used or a booking is made.

3 – Reservations

Confirmation of a booking via the website constitutes a contract for the provision of temporary accommodation services entered into between “PJA – Açores Youth Hostels, Unipessoal Lda.” and the user/client. Acceptance of these Terms and Conditions is formalised by ticking the selection box on the booking form, also implying knowledge and acceptance of the Privacy Policy and Cookie Policy.

The customer must correctly complete the form, indicating their desired accommodation, check-in and check-out dates, applicable rate, and the total number of guests, including a mandatory specification of any children and infants.

All reservations are subject to availability and confirmation by Azores Youth Hostels, and the customer must provide true, complete, and up-to-date personal data and payment information.

The inclusion of children and babies must always be communicated, with the reservation depending on the availability of cots and/or extra beds and the space available in the accommodation unit.

Whenever a booking exceeds the maximum occupancy for the room or dormitory, an extra bed may be provided. This bed may not offer the same level of comfort as the other beds. The customer acknowledges that the installation of an extra bed reduces the usable floor space of the room and does not entitle them to any compensation or contractual changes.

All bookings made online include breakfast.

The making of reservations, as well as any changes or cancellations, may be subject to the payment of fees, duly communicated to the client at the time of booking.

Following confirmation of the details provided, the customer will be assigned a booking code, sent to the email address indicated, and this must be mentioned in all communications with Azores Youth Hostels.

All requested documents, namely identity card or passport and credit card, must be presented at the time of check-in, in physical format, with the client being responsible for their obtaining and validity. The lack of any mandatory document may result in the cancellation of the reservation, without the right to a refund, compensation or change of dates. In addition to the reservation amount, a municipal tourist tax is due in the amount of €2 per person per night, up to a maximum of 3 nights (total of €6 per person), to be paid locally at check-in.

4 – Accommodation

Azores Youth Hostels offers, subject to availability, twin rooms with private or shared bathrooms, triple rooms with private or shared bathrooms, and beds in female or mixed dormitories.

The specific characteristics of each accommodation are those stated in the booking. The photographs shown on the website are for illustrative purposes only and may not fully reflect the current state of the accommodation at the time of your stay. Non-substantial differences between the images and reality do not entitle the customer to compensation or contractual changes.

5 – Entry and exit (check-in and check-out)

Accommodation can only be occupied from 3:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. Any request to change these times must be previously communicated and approved by the Azores Youth Hostels team.

If the customer does not check in on the scheduled date of arrival – by 11:00 PM (twenty-three hours) on the day of arrival, or by 11:59 PM (twenty-three hours and fifty-nine minutes) in the case of the Azores Youth Hostels accommodation on São Miguel – and does not communicate the delay in advance, Azores Youth Hostels reserves the right to cancel the reservation without the right to a refund, with such a situation conferring no right to compensation, date changes, or reimbursement of amounts paid.

If the guest does not check out by 11:00 AM, an additional day's stay will be charged at the rate applicable on that day.

The presentation of a valid credit card, in the name of the reservation holder, is mandatory at the time of check-in. Failure to present or refusal to present the card will prevent check-in and invalidate the stay, with no right to a refund, change of dates, or compensation.

6 – Cancellations and changes to reservations

The cancellation policies applicable to bookings made through the website are determined by the selected rate:

  • Standard Tariff Free cancellation up to 72 hours before the scheduled arrival date. Cancellations made less than 72 hours before will not be eligible for a refund, date change, or compensation.
  • Non-refundable rate: The amount paid is non-refundable, regardless of how far in advance the cancellation is made.
 

PJA reserves the right to cancel or modify bookings whenever an invalid credit card is presented, or when there are indications of fraudulent, improper, or contrary activities to these Terms and Conditions.

Any changes intended by the client must be communicated to the respective accommodation beforehand and are subject to their approval. Requested changes may imply modifications to the price and/or the payment of additional fees, calculated based on the type of booking, the rate selected, and the date on which the change is requested.

Whenever necessary, the reserved accommodation unit may be replaced by another of equal or higher category, subject to the client’s agreement and without any additional charge to the price initially paid.

7 – Offers and discounts

Promotions and discounts, whether temporary or permanent, may be made available for bookings made on the website. To benefit from certain campaigns, it may be necessary to enter a promotional code or to pay for the booking in advance.

Promotions and discounts are always subject to availability at the time of booking.

In the event of cancellation or non-usage of a booking made under a promotional campaign, the value corresponding to the applied discount will not be refunded, nor will its reapplication in future bookings be guaranteed.

8 – Payment

Payment methods vary depending on the selected fare:

  • Standard Rate: The total amount will be held on the credit card and debited three days before the check-in date.
  • Non-Refundable Rate: The full amount must be paid in full at the time of booking. Payment for bookings must be made by credit or debit card.
 

PJA is not responsible for bank charges or other external costs associated with payment.

The prices shown include VAT at the current statutory rate.

9 – Exclusion of the Right to Unrestricted Termination of Contract

Under Article 17(k) of Decree-Law No. 24/2014, of 14 February, the customer does not have the right to terminate the contract within 14 days.

10 – Complaints

All Azores Youth Hostels establishments have a Complaints Book, in physical and electronic format. Complaints can be made in person or through the official portal: https://www.livroreclamacoes.pt/inicio

11 – Alternative Dispute Resolution

In accordance with Law No. 144/2015, of 8 September, consumers may have recourse to Alternative Consumer Dispute Resolution Entities, listed on the website provided by the General Directorate for Consumers at http://www.consumidor.pt

12 – Intellectual Property

PJA is the owner of all intellectual property rights associated with the website, including content, trademarks, logos, text, images, design, functionalities, and other elements protected by applicable legislation. The user's use of this content does not grant any ownership rights or licence, except with the express written authorisation of PJA.

The user declares to have read and understood these Terms and Conditions, acknowledging that they constitute the full and exclusive statement of the agreement entered into with PJA, superseding any prior communication, proposal, or agreement, whether written or oral, relating to the subject of this contract.”
